AB 3057 is a technical fix to existing law that will grant local Junior ADU ordinances the same exemption to environmental review that is already granted to standard ADU ordinances.

Thanks to state efforts to increase housing production and address California’s housing shortage, ADU construction has grown massively over the last several years, resulting in thousands of new, affordable rental homes across California.

State incentives and protections treat standard ADUs similarly to Junior ADUs, especially small accessory units created entirely within a home’s existing walls.

Current law exempts ADU ordinances that are bringing local ADU rules into compliance with state law from CEQA review, allowing cities to implement state ADU law faster and easier. However, a gap in current law denies Junior ADU ordinances the same exemption.

AB 3057 passed the Assembly by a vote of 73-0, with 7 abstentions, on 5/2/24. It passed the Senate Environmental Quality Committee on 6/5/24 and passed the Senate Housing Committee on 7/2/24 by a 10-0 vote. It passed the Senate on 8/12/24 by a vote of 37-0. Governor Newsom signed it into law on 8/27/24.
